This is an action by a minor plaintiff to recover damages for injuries sustained by her when she was struck by an automobile driven by the defendant George W. Dibelius, Jr. Her father joined in the action to recover for necessary medical and nursing care for her. The case was tried to the court and a jury. Questions were submitted to the jury in a special verdict inquiring as to the negligence of the defendant Dibelius with respect to lookout, speed, and management and control. The jury determined that the defendant Dibelius was not negligent in any of said respects and a judgment was entered on March 30, 1953, dismissing the plaintiffs complaint with costs. The plaintiffs appealed from said judgment.
